1. Acceptance of Terms

By downloading, installing, or using the SkyBound mobile application or visiting findballoonrides.com or skybounddashboard.com (collectively, the "Service"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.

2. Description of Service

SkyBound provides tools for hot-air-balloon pilots including flight tracking, flight logging, weather briefings, crew coordination, pilot directory listings, booking management, invoicing, and related features. Some features require a paid subscription.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide accurate and complete information and to keep it up to date.

4. Subscriptions & Payments

SkyBound offers auto-renewable subscription plans. By subscribing, you agree to the following:

  • Payment: Subscription fees are charged through the Apple App Store (via Apple's in-app purchase system) or Stripe (on the web). Payment is charged at confirmation of purchase.
  • Renewal: Subscriptions automatically renew at the end of each billing period (monthly or yearly) unless cancelled at least 24 hours before the end of the current period.
  • Cancellation: You may cancel your subscription at any time through your Apple ID account settings (iOS) or through your account settings on the web. Cancellation takes effect at the end of the current billing period.
  • Price changes: We may change subscription prices. You will be notified in advance and given the opportunity to cancel before the new price takes effect.
  • Free trials: If offered, free trial periods convert to paid subscriptions unless cancelled before the trial ends.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Impersonate another person or entity
  • Interfere with or disrupt the Service or its servers
  • Attempt to gain unauthorized access to any part of the Service
  • Upload malicious code or content
  • Use the Service to harass, abuse, or harm others

6. User Content

You retain ownership of content you upload to the Service (photos, flight data, profile information). By uploading content, you grant SkyBound a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content as necessary to provide the Service (for example, displaying your profile in the pilot directory).

7. Location Data & Flight Safety

The Service uses GPS location data for flight tracking and related features. SkyBound is a tool to assist pilots and is not a substitute for proper flight planning, safety equipment, or regulatory compliance. You are solely responsible for the safe operation of your balloon and compliance with all applicable aviation regulations.

8. Intellectual Property

The Service, including its design, code, features, and branding, is owned by SkyBound and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. SkyBound does not warrant that the Service will be uninterrupted, error-free, or that any defects will be corrected. Weather data, elevation data, and other third-party information are provided for informational purposes only and may not be accurate.

10. Limitation of Liability

To the maximum extent permitted by law, SkyBound shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to damages arising from flight operations, data loss, or service interruptions.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Continued use of the Service after changes constitutes acceptance of the new Terms.
